Are your products legal?
THCA, or tetrahydrocannabinolic acid, is a cannabinoid that is found naturally in the cannabis plant, including in hemp plants. It is the precursor to THC, which is the primary psychoactive compound in marijuana.
In 2018, the US government passed the Agricultural Improvement Act, commonly known as the Farm Bill, which legalized the production and sale of hemp-derived products, including hemp-derived flowers, in all 50 states. The Farm Bill defined hemp as cannabis with less than 0.3% THC by dry weight and removed it from the list of controlled substances.
The hemp-derived flower that meets this criterion is legal because it is not considered to be marijuana, which is still classified as a Schedule I controlled substance under federal law. However, it is important to note that individual states may have their own laws and regulations regarding the production, sale, and use of hemp-derived products, so it is important to research and understand the laws in your specific state.
As for THCA, it is also legal in all 50 states because it is found naturally in hemp plants and is not a controlled substance. However, it is important to note that THCA does not have psychoactive effects on its own, as it must be decarboxylated (heated) to convert it into THC. Therefore, products containing THCA are typically marketed for their potential therapeutic benefits, rather than their psychoactive effects.
